Question on Macedonian minority in Bulgaria

If a Member State contravenes Article 2 of the Treaty on European Union and Article 21 of the Charter of Fundamental Rights of the EU, and the Commission does not intervene, is the Commission complying with its obligations as the ‘guardian’ of the Treaties?
